These terms and conditions set out the terms of use of the Ice Network, websites, mobile application or any other application running in the Ice Network ecosystem. By browsing the websites or mobile app, downloading the mobile app, or registering accounts you acknowledge that you have read and that you have agreed to be bound by these terms and conditions and to follow them at all times.
Please read these Terms of Services carefully before using the Service. By using or otherwise accessing the Services, or clicking to accept or agree to these Terms where that option is made available, you accept and agree to these Terms consent to the collection, use, disclosure and other handling of information as described in our Privacy Policy and agree to and accept any additional terms, rules and conditions of participation issued by Ice Network from time to time. If you do not agree to the Terms, then you may not access or use the Services, access the websites, use the mobile app or other applications in the Ice ecosystem.
1. Modification of Terms of Service
Ice Network reserves the right, at its sole discretion, to modify or replace the Terms of Service at any time. The most current version of these Terms will be posted on our site. You are responsible for reviewing and becoming familiar with any such modifications. Use of the Services by you after any modification to the Terms constitutes your acceptance of the Terms of Use as modified.
2. Eligibility
You hereby represent and warrant that you are fully able and competent to enter into the terms, conditions, obligations, representations, statements and warranties set forth in these Terms and that you are using the sites, mobile app and other applications solely for your personal use and that you will comply with and abide by these Terms.
Ice Network is a global platform and by accessing the Content or Services, you represent and warrant that, you are of the legal age of majority in your jurisdiction as required to access such Services and Content and to enter into agreements as required by the Service. You also represent that you are legally authorized to use the Service in your jurisdiction, including holding cryptographic tokens of value and interacting with the Services or Content in any manner. You also represent that you are responsible for ensuring compliance with the laws of your jurisdiction and acknowledge that Ice Network is not responsible for your compliance with such laws.
3. Limitation of Liability
We provide the service without any guarantees or warranties. Whilst we try to ensure that the content of the website or mobile app is correct we are not responsible if it is not correct. We do not guarantee or represent that any information, content, advertisements or any other website or mobile app which you may access through our website or mobile app are accurate or reliable or that it meets your requirements.
We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, and any term as to the provision of services to a standard of reasonable care and skill or as to non-infringement of any intellectual property right.
We do not accept responsibility for any defects which may exist, or for any costs, loss of profits, loss of data or consequences arising from your use of, or inability to access the website or mobile app.
We do not accept any responsibility or liability for enabling you to link to any other website or mobile app, or for the contents of any other website or mobile app, whether one from which you may have been linked or to which you may link from the website or mobile app, or for any consequence of your acting upon the contents of such website or mobile app.
We do not accept any liability for your dealings or contracts via the service with other users of the Service or any other third party.
We do not accept any liability (whether in contract, tort or otherwise) for any acts or omissions resulting from your decision formed on the basis of your use of the service.
Events Beyond Your or Our Control
Neither you or we shall be liable to the other for any delay or failure to comply with our respective obligations under these terms and conditions if the delay or failure arises from any course which is beyond our reasonable control, including (without limitation) any act of God, or of Government or Regulatory Authority or other internet service providers, war, terrorism or non-availability or mail functioning of a telecommunications or broadcast or other network system or service.
Ice Network assumes no responsibility, and shall not be liable for any damages to, or viruses that may infect your computer, telecommunication equipment, or other property caused by or arising from your access to use of, or browsing the Site or your downloading of any materials, from the Site.
You must compensate us for any damage, which we suffer because of something you have done or in the event of your breach of these terms and conditions.
4. Access to Services
We cannot guarantee that our services will be uninterrupted and error-free. We cannot be liable if we are unable to provide our service for any reason beyond our control.
Ice Labs Limited disclaims liability for any coding or system bugs, as well as for any full or partial disruption of service delivery, which is provided on a “best efforts” approach.
Your access to the Service may be restricted from time to time to allow for repairs, maintenance or the introduction of new facilities or services. If this happens, we will attempt to restore the Service as soon as reasonably possible.
4.1. Pres-Stake and Stake services
Pre-Stake is a service and opportunity offered to users in Phase 1 of the Ice project and is defined as a commitment by the user to stake an amount of Ice coins from the date the Ice project moves into Phase 2, the stage of the live launch of the Mainnet and the completion of KYC procedures by the user. In return for this commitment, the user is rewarded in two ways:
- In Phase 1 the user will receive a bonus of up to 250% applied to the volume of Ice coins staked, depending on the period of years (1 year – 5 years) they have chosen for the stake.
- In Phase 2 the user will receive a percentage reward for each year for which they have committed to staking.
All these commitments are automatically honoured, they are written into the system software and the code can be checked by anyone interested, it is publicly available on GitHub in a transparent way.
As the project is a decentralised project where DAO (Decentralised Autonomous Organisation) principles will operate in Phase 2, Ice Labs Limited disclaims responsibility for determining the amount of rewards for staking. These rewards are influenced by a number of parameters whose value will be determined through decentralised governance mechanisms, i.e. by direct vote of those who have made the commitment to stake.
5. Limitations on use of the Service
- You agree not to offer any sale of Ice units or any derivatives of such units by you for other currencies prior to the launch of the Ice Network Mainnet.
- You agree that you and you alone are the exclusive owner of this account and the Ice units associated with your account and that you will not transfer your account to any other person, group or organization.
- You acknowledge and agree to the condition that you register on the network with only one account and one device, and during Phase 1, you must follow the KYC Step #1 procedure, the face recognition authentication procedure.
In the last stage of KYC, users will have the opportunity to be verified as human beings and demonstrate their knowledge of the project through a 21-question Test. The test is considered passed if at least 18 correct answers are given. Users have three chances to pass the quiz within a two-week period. If they fail to do so or take no action within two weeks, their account will enter into permanent slashing, making the account irrecoverable. Users who have opened multiple accounts on multiple devices, run bots, engaged in the operation of automated bots, disseminated content revealing answers to the quiz, or distributed materials on any platform that are deemed defamatory or detrimental to the reputation and interests of the Ice project, will face immediate account termination without prior notice. - You agree not to engage in any illicit and/or illegal transactions using Ice.
- You agree not to engage in, or attempt to engage in activity that seeks to defraud us or any other person or entity, including, but not limited to, providing any false, inaccurate, or misleading information in order to unlawfully obtain the property of another.
- You agree not to engage in activity that transmits, exchanges, or is otherwise supported by the direct or indirect proceeds of criminal, terrorist or fraudulent activity.
Violation of any of these terms may result in the invalidation of your account and forfeiture of your entire balance. You agree that you assume full responsibility in the event of invalidation of your account and cancellation of your balance. Ice Labs Limited and the Ice Network and its developers bear no liability if your account is invalidated, your balance is cancelled or if transferred Ice units are cancelled.
6. Links
The Service may provide, or third parties may provide, links to other internet website or mobile apps or resources. Because we have no control over such website or mobile apps and resources, you acknowledge and agree that we are not responsible for the availability of such external website or mobile apps or resources, and do not endorse and are not responsible or liable for any content, advertising, products, or other materials on or available from such website or mobile apps or resources.
We will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such website or mobile app or resource
7. Suspension or termination of Our Services
We may suspend, restrict, reduce or terminate the Service to you immediately without any compensation if you breach any of these terms.
8. Website and Applications security
You acknowledge that blockchain applications are code subject to defects and acknowledge that you are solely responsible for evaluating any code provided by the Services or Content and the reliability of any third-party websites, products, smart contracts or Content that you access or use through the Service.
You also expressly acknowledge and represent that blockchain applications developed by third-party may be written with malice or negligence, that Ice Network cannot be held liable for your interaction with such applications, and that such applications may cause loss of ownership or even identity. This warning and others subsequently provided by Ice Network do not constitute, and in no way constitute, a continuing obligation to advise you of all potential risks of using the Services or third-party mobile applications.
9. Volatility of Crypto Currencies
By accepting the Terms of Service you understand that blockchain technologies and associated coins or tokens are highly volatile due to many factors, including but not limited to adoption, speculation, technological and security risks.
You also recognize that once the Ice Mainnet goes live or Ice is listed on an exchange, Ice will experience similar volatility and will be subject to the same factors faced by other cryptocurrencies. Recognize also that the cost of transactions on such technologies is variable and can increase at any time, causing an impact on any activities that take place on blockchains.
You acknowledge these risks and represent that Ice Network cannot be held liable for such fluctuations or increased costs.
10. Proprietary Rights
You acknowledge and agree that the Service, website, mobile application, their design, code, network architecture, all software products that are contained on the website or mobile application, graphics, are subject to intellectual property rights that are owned by Ice Network and its Licensors and are protected by applicable intellectual property and other laws. Unless you are expressly authorized by Ice Network, you agree not to copy, modify, rent, lease, loan, sell, distribute, perform, display or create derivative works based on the Service or Content, in whole or in part.
Ice Network’s trademarks and the Ice design (the “Trademarks”) are trademarks of Ice Network and its parent company. You may not use the Trademarks without Ice Network’s prior written permission.
11. Risk of Regulatory Actions
You acknowledge and understand that Ice Network and the crypto currencies you store on Ice Network may be affected by one or more regulatory actions, which may prevent or limit Ice Network’s ability to continue to develop, or which may prevent or limit your ability to access or use the Service.
12. Statute of Limitations
You agree that any claim or cause of action arising out of or related to the use of the Service or the Terms must be filed within one (1) year after such claim or cause of action arose, or another period as provided under statute or law, or be forever barred
13. Governing Law
This Agreement is governed by British Virgin Islands law, without regard to conflicts of law principles. The exclusive jurisdiction and venue for disputes under or relating to the Agreement are the District Court of the Virgin Islands, BVI. You consent to jurisdiction and venue in such courts.
